REPORTING ON GREENHOUSE GAS (GHG) INVENTORY AT FACILITY-LEVEL IN INDUSTRY AND TRADE SECTOR

Overview

Greenhouse gas (GHG) inventory is defined that is the measurement of greenhouse gas emissions emitted by humans over a specified area within a period of 1 year. GHG inventory is applied to a business, organization, locality, country or community.

From January 1, 2022, the Law on Environmental Protection 2020 (Law No. 72/2020/QH14) comes into effect, businesses in the List of GHG emission facilities must conduct GHG inventory. According to Clause 7, Article 91 of the Law on Environmental Protection 2020, it is stipulated as follows: Facilities emitting GHGs that are on the list of facilities required to conduct GHG inventories are responsible for the following:

a) Organizing the implementation of GHG inventories, building and maintaining a GHG emissions database system and sending the GHG inventory results every two years to the Ministry of Natural Resources and Environment before December 1 of the reporting period for synthesis and reporting to the Prime Minister;

b) Developing and implementing annual GHG emission reduction plans; integrating GHG emission reduction activities with the quality management program, cleaner production program, and environmental protection program of the facility;

c) Annually, prepare a report on GHG emission reduction to implement the facility’s GHG emission reduction plan according to the measurement, reporting and appraisal system and send it to the Ministry of Natural Resources and Environment and relevant Ministries, ministerial-level agencies and provincial People’s Committees before December 31 of the reporting period.

Implementation sequence

On that basis, and based on Decree No. 06/2022/ND-CP of the Government: Regulations on greenhouse gas emission mitigation and ozone layer protection (issued on January 7, 2022, effective on January 7, 2022), the Ministry of Industry and Trade issued Circular No. 38/2023/TT-BCT regulating the techniques for measurement, reporting, and verification (MRV) of greenhouse gas emission mitigation and greenhouse gas inventory in the Industry and Trade sector issued on December 27, 2023, stipulating the process of greenhouse gas inventory at the grassroots level under the Industry and Trade sector to be implemented in the following 8 steps:

  1. Determine the scope of the facility-level greenhouse gas inventory
  2. Collect data on facility-level greenhouse gas inventory activities
  3. Select the facility-level greenhouse gas emission coefficient
  4. Determine the facility-level greenhouse gas inventory method
  5. Implement quality control of facility-level greenhouse gas inventory
  6. Assessing the uncertainty of the facility-level greenhouse gas inventory
  7. Recalculating the results of the facility-level greenhouse gas inventory
  8. Developing the facility-level greenhouse gas inventory report

Implementation deadline

Pursuant to Clause 5, Article 91, Law on Environmental Protection 2020 and Point b, Clause 4, Article 11, Decree 06/2022/ND-CP, the deadline for the facility-level greenhouse gas inventory is prescribed as follows:

  • Facilities are responsible for organizing the implementation of facility-level greenhouse gas inventories, developing periodic grassroots greenhouse gas inventory reports every two years for 2024 onwards and submitting them to the Provincial People’s Committee before March 31, 2025;
  • Organize the implementation of greenhouse gas inventories and send the results of the greenhouse gas inventories every two years to the Ministry of Natural Resources and Environment before January 31 of the next reporting period for synthesis and reporting to the Prime Minister.
